When do I need liability insurance?

Are you working in an independent or contract setting? Practising dietetics requires liability insurance.

The Practice Advisory Service receives calls from dietitians who often have questions about when they need liability insurance.

A recent call from a dietitian, who was interested in a community contract role, highlighted this issue. Although they would be working for a company, they would be hired as an independent contractor and not an employee.  They had heard from other dietitian contractors that insurance may not be needed. They wanted to know if this was true.

Practising Dietetics Requires Insurance

Professional liability insurance protects a dietitian in case of legal liability incurred through their practice, but it also protects clients if they are harmed or wronged by a dietitian.

Dietitians in Ontario must hold valid professional liability insurance if they are practising the profession, according to the Registration Regulation and College by-law. Generally, when a dietitian applies their food and nutrition knowledge, skill and judgment — they are considered to be practising dietetics. The definition of practising dietetics can help dietitians determine if this requirement applies.

If a dietitian is practising, they should check with the company who hired them as to whether insurance will be provided for them, that it meets the by-law requirements or if they need to arrange their own insurance. It’s important not to make assumptions about insurance and to verify information. Your registration may be significantly impacted if you do not hold valid professional liability insurance.

Dietitians need professional liability insurance that meets the following requirements:

  • minimum coverage of no less than $2,000,000 per occurrence.
  • aggregate coverage of no less than $5,000,000.
  • any deductible must be $1,000 or less.
  • For “claims made” policies, an extended reporting period provision of at least two (2) years.

Bottom line: Professional liability insurance is a mandatory requirement if you are practising dietetics, regardless of your employment model or practice setting.
